Thank you for using mnml.ai services. mnml.ai is a platform that provides AI services for generating assets (photos and text) using AI models, and hosts the assets for users who have signed up for our services. By using our website and services, you agree to be bound by the following terms and conditions. If you do not agree to these terms, please do not use the website.
mnml.ai provides its users with AI-generated images and text through its platform, which users may access and use subject to the terms and conditions outlined in this agreement.
By using mnml.ai, you agree to abide by all applicable laws and regulations and to not engage in any of the following activities:
Users of mnml.ai may upload and store photos and text generated using our services. By doing so, users represent and warrant that they have all necessary rights and permissions to use and upload such content. Users own their assets (generated images and text), and mnml.ai will make these assets publicly available on the web if user profile visibility is set to "Public".
All images generated by free users may appear in the community page which shows latest design generations for a period of time. These images may be picked to be showcased on other pages on mnml.ai to highlight good use cases of the website.
As long as you comply with the terms outlined in this agreement and any limitations set by law, you are granted a limited, non-transferable, non-sublicensable, non-assignable, and revocable license to access and use the Service for personal or business purposes. Any assets created using the Service are owned by you, and mnml.ai assigns all rights, title, and interest in those assets to you for your personal or commercial use for paid users. Each individual must have their own account, and you are responsible for all activity on your account. If you breach any of our Terms of Service, your right to use our Service may be terminated immediately.
Where an account is provisioned, paid for, or administered under an Enterprise or Team plan (including our Team Starter, Team Growth, and Enterprise tiers), the organization that holds the subscription (the "Enterprise") is the account holder. In that case, assets created by users under the Enterprise's plan in the course of their work for the Enterprise are owned by the Enterprise, and each member's license to access and use those assets is granted through, and limited by, the Enterprise's account. mnml.ai assigns all rights, title, and interest in those assets to the Enterprise for its commercial use. The Enterprise is responsible for managing its members' access, and members' rights to assets may be administered, transferred, or revoked by the Enterprise's account administrators. Upgrading or downgrading between plan tiers (for example, from Team Starter to Team Growth) does not change this ownership model.
Enterprise customers may enter into a separate enterprise agreement (such as a Master Services Agreement and Data Processing Agreement) with mnml.ai. Where such an agreement exists, its terms govern asset ownership, data handling, and any conflicting provisions, and prevail over the corresponding provisions of these Terms of Service. At mnml.ai, we strive to ensure our users are confident in their purchase decisions. To help you experience our service, we offer free credits for you to try before buying. As such, all purchases are final, and we do not offer refunds after a purchase has been made.
mnml.ai provides its services on an "as is" and "as available" basis. We do not warrant that our services will be error-free or uninterrupted. We make no guarantees that any of the assets generated by our AI service will be suitable for any particular purpose.
To the maximum extent permitted by law, mnml.ai and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service or these terms, whether based in contract, tort, or any other legal theory.
To the maximum extent permitted by law, mnml.ai's total aggregate liability for all claims arising out of or relating to the Service or these terms will not exceed the greater of (a) the total fees you paid to mnml.ai in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 100.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
You agree to indemnify and hold mnml.ai and its affiliates harmless from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Service or your violation of these terms.

mnml.ai reserves the right to modify these terms of service at any time. For material changes, we will provide at least 30 days advance notice via email before the changes take effect. Users will also be notified on the website. Continued use of mnml.ai after such changes have been made constitutes acceptance of the modified terms.
The Service is operated by mnml.ai LLC-FZ, a free zone company registered in Meydan Free Zone, Dubai, United Arab Emirates. These terms of service are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to its conflict-of-law principles. Subject to the paragraph below and to any mandatory consumer-protection rights available to you in your country of residence, you and mnml.ai LLC-FZ submit to the exclusive jurisdiction of the courts of the Emirate of Dubai, United Arab Emirates, for the resolution of any dispute arising out of or relating to these terms or the Service.
Before initiating formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us via our contact page. Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information. Where you contract with mnml.ai under a separate enterprise agreement, the governing law and dispute-resolution provisions of that agreement prevail over this section.
If any provision of these terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect. The invalidity or unenforceability of any provision in a particular jurisdiction does not affect the validity or enforceability of that provision in any other jurisdiction.
